Scalia and Kennedy 2007-2008: A Swing and a Legacy

The United States Supreme Court has begun to change under Chief Justice Roberts. In the 2007-2008 session, there appeared to be less disagreement than in 2006-2007. But, the differences are still pronounced.

This presentation looks at the changes in the Roberts' Court through some of the decisions of Scalia and Kennedy. Kennedy's increasing role as the swing vote in major cases takes on the mantle of a nation's moral conscience. Scalia's dissents continue to be better reading than some other justice's opinions, but in the last case of the 2007-2008 session, his opinion may redefine what constitutes a landmark case.

The presentation lasts for 1 hour and 40 minutes with at least 20 minutes for direct questions.
